Plaintiff has sued the Department of Justice ("DOJ") and other federal defendants under the Freedom of Information Act ("FOIA") in connection with the search for documents in a criminal investigation of Plaintiff. Before the Court is Defendant's Motion for Summary Judgment (Docket No. 4). For the reasons set forth below, Defendant's Motion for Summary Judgment is GRANTED in part and DENIED in part. I. Plaintiff is a citizen group who is seeking release of documents relating to a criminal investigation of Plaintiff's participation in a conference in San Antonio, Texas, on February 27, 2000. On February 27, 2000, a criminal investigation was conducted at Lake Amistad National Recreation Area in San Antonio, Texas, as a result of complaints from the owner of the park regarding the presence of pot plants and the conduct of a conference held at the park. On February 28, 2000, an affidavit of probable cause was signed. On March 1, 2000, the FBI executed search warrants for the Park and for Plaintiff's residence. Approximately five hundred pages of documents were seized, with a portion of the documents being withheld from release. On March 9, 2000, a warrant to search Plaintiff's residence was executed, and additional documents were seized. On January 12, 2001, Plaintiff filed an administrative appeal to the DOJ of the denial of its request for documents from the FBI in connection with the search of the park, and from the FBI in connection with the investigation of the conference held at the park. Plaintiff requested that the DOJ release all responsive records of documents relating to the park search and the investigation of the conference held at the park. The DOJ
